Upfront Payment or Backend Royalties? How to Negotiate the Deal

If you’re an artist or creative entrepreneur, chances are you’ll face this dilemma at some point:


Take a lump sum now… or bet on future royalties?


There’s no one-size-fits-all answer - but there are key questions that can help you make a smarter decision. Here's how I help my clients think it through:


Would you rather $100k upfront or 2% on the backend?


What's the Real Tradeoff?


At a high level:


  • Upfront Fee: Immediate, guaranteed payment. No future upside.

  • Backend Royalties: Ongoing earnings tied to how the project performs - but not guaranteed.


The backend can seem attractive (“2% of forever!” sounds nice), but it comes with risks. Once royalties are involved, the legal complexities increase - fast! Now you're entering a long-term financial relationship that requires tight deal terms and ongoing transparency. Therefore, there are some key you'll need to negotiate.



Questions to Ask When Negotiating Backend Royalties


Before saying yes to backend participation, ask yourself:


  • Have I modelled earnings to compare my options?

  • Am I using past comps and realistic projections? (and am I being honest?)

  • Have I maximized the pool of revenue I get paid on?

  • What comes off the top before I get paid?

  • Can I audit the books if things seem off?

  • Is the release guaranteed? (no release = no royalties)

  • Is there a real marketing and promotion budget?

  • Do I trust the royalty payor?

  • Will they still exist in 5–10 years?

  • What are my legal options if the deal goes sideways?

  • Would a hybrid deal (e.g., $25K upfront and 1% royalty) be smarter?


It Comes Down to Negotiation


It’s not always either/or. Sometimes, the best deal involves a hybrid structure: a smaller upfront fee or advance + lower backend royalty.
